This website is operated by Olive Branch Culinary Services. Throughout the site, the terms, “we”, “us”, “our”, “Olive Branch Culinary Service” refer to Olive Branch Culinary Services. Olive Branch Culinary Services offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. 

 

By visiting our site and/or purchasing products and services from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and condition and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including, without limitation, users who are browsers, vendors, customers, merchants, and/or contributors of content.

 

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the Terms of Conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service. 

 

Any new features or tools which are added to currently website shall also be subject to the Terms of Service. You can view review the most current version of the Terms & Service at anytime on this page. We reserver the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. You continued use of or access to the website following the posting of any changes constitutes acceptance of these changes. 

 

This website is not for use by any minors (defined as those who are not at least 18 years of age), and you must not use this Website if you a minor.

 

Online Terms

By agreeing to these Terms of Service, you represent that you are at least the age of majority is your state or residence, or that you are the age of majority in your state or residence and you have given us your consult to allow any of your minor depends to use this website.

 

You may not use our services for any illegal or unauthorized purpose no may you, in the use of the Service, violate any laws in your jurisdiction, including but not limited to copyright laws.

 

You must not transmit any viruses or any code of a destructive nature. 

 

A breach or violation of any of the Terms will result in an immediate termination of your Services.

 

General Conditions & Accuracy 

We reserve the right to refuse service to anyone for any reason at any time. 

 

You agree not to reproduce, duplicate, copy, sell, resell,  or exploit any portion of the Service, Use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

 

Olive Branch Culinary Services provides materials on this website for you for your convenience and provides general service information. This website may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the content of this website at anytime, but we have no obligation to update any information on our website. You agree that is it your responsibility to monitor changes to our website.

Out of Town Written Notice

If you are planning to be out town, please email Taka Ono directly at taka.ono@olivebranchcs.com. This way he is able to update our service date calendar and your Out of Town Notice does not get lost in the menu confirmation email. 

 

Menus

Menus are custom designed for you by Olive Branch Culinary Services. Your menu each week is based on your preferences selected in your Intake Form.

 

After your menu is designed each week, it will be emailed to you for your approval. You have 24 hours from the time it was emailed to request that any changes be made. If Olive Branch hasn’t received a response within 24 hours, then the menu will be put in place and no changes can be made at that point.

Chef Working Conditions

Upon arrival of the chef at your home, the kitchen must be clean and usable by the chef. Most importantly, dirty dishes have been taken care of, and there is clean counter space. If any cleaning beyond 5 minutes is required by the chef, in order for them to work productively, then a cleaning fee will be charged. 

 

We also require sufficient refrigerator space to store your completed meals in. Please make sure there is space before the chef’s arrival. 

 

Upon completion of cooking, the chef will clean the areas of the kitchen used, and leave the kitchen in the same or better condition as found upon arrival. Chef’s cleaning duties include washing and putting away dishes, wiping surfaces, removing trash, and sweeping the floor. Mopping of floor will be done if needed, at chef’s discretion. Chef will double check that appliances are turned off before leaving.

For safety and sanitary reasons, pets and small children must be kept out of the kitchen/chef’s work space. 

 

Chef Service Fees & Grocery Shopping

The grocery shopping for the ingredients to prepare your food is included in the service price. The chef can pick up 1-5 extra items, upon request, for no extra charge. For more than 5 extra items, a $55 shopping fee will be charged, for up to 30 extra minutes of shopping. 

A shopping list for the extra items must be provided by the client, and emailed directly to the chef, by 5pm the day before the shopping is to be done.

Deposit & Payment 

A grocery deposit/retainer is required prior to the first day of service. The deposit will be fully refunded upon discontinuation of service. The deposit amount is $200-$250 (unless otherwise agreed upon) and will be billed via Quickbooks/Intuit. 


For each cook date, an invoice will be emailed through Quickbooks/Intuit Payment System. All related Chef Service Fee  or other related chef services payments are processed with either ACH(1% processing fee), or Credit Card (3.5%  processing fee) which will be added to the total invoice amount due. If payment fails, we will attend to try again. If payments fails for the second time, someone in our admin office will reach out to you regarding payment issue. If client fails to get back to us within 7 business days to provide Olive Branch Culinary Services with a new payment method, we will have to file dispute with the Small Claims Court to receive payment of service rendered.

 
Payment is due upon receipt
of invoice. Payment must be received no later than 24 hours before your next cook date or the cook date will be cancelled.

Late Payment 

Starting on Monday, June 22nd, 2020, the following fees may be charged, all of which are subject to change without notice:  Late Payment Fee if payment is not received by the billing due date a late fee may be assessed. The late fee is three percent (3%) or the maximum amount permitted under state law per month until the delinquent amount is paid in full. Credit is not extended to the Client. This is not an interest or finance fee.  If you wish to have payment on file, please send us an email to info@olivebranchcs.com, and we would be happy to you send you a secure form for ACH or Credit Card.

Taxes
Client is responsible for all taxes or government fees and charges, if which is asses based on the Chef Service Fee provided. Any amount of the Chef Service Fee to client may be subject to tax, which will vary according applicable local and state law. 

 

Cancellation Policy

One week’s notice is required to cancel a cook date. More advanced notice is appreciated. If you are unable to provide one week’s notice, a cancellation fee of $50 will be charged.

 

Olive Branch reserves the right to cancel a cook date due to unsafe weather, illness, or other reason. If a cook date must be canceled, we will attempt to reschedule it for another day during the same week.   

 

Right to Refuse Services

Olive Branch Culinary Services, in its sole discretion, reserves the right to refuse service to anyone, with or without cause or reason. Olive Branch Culinary Services reserves the right to add, delete or change fees or charges at any time.

 

Liability Disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED OR IN OR AVAILABLE THROUGH THE WEBSITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. OLIVE BRANCH CULINARY SERVICES, AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE WEBSITE AT ANYTIME.

Assumption of Risk

Purchasing pre-cooked meals comes with its certain inherent risks that cannot be eliminated regardless of the care taken. The specific risks vary, and can include, but are not limited to, cooking food thoroughly; separating and not cross contaminating foods; chilling or refrigerating food appropriately; cleaning foodstuffs, instruments and hands used in and for food preparation; fire or gas hazards. Do not leave cooler bags out for more than 2 hours after delivery.

 

Indemnification and Hold Harmless

I agree to INDEMNIFY AND HOLD HARMLESS Olive Branch Culinary Services, their affiliates, direct or indirect, officers, employees, businesses and agents (the “Indemnitees”) from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of my purchasing pre-cooked meals, whether brought by me, my company or its agents or employees, or other third parties, and to reimburse the Indemnitees for any such expenses incurred. 

 

Acknowledgment of Understanding 

I have read this Waiver of Liability, Assumption of Risk, and Indemnity Agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, am over the age of 18, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law. 

 

Gift Cards Disclaimer

Gift Cards: All gift card sales are final. No exceptions. The end user is solely responsible for protecting the value of the e-card by keeping the unique gift card number secure and in a safe place. All gift card purchase are made via third-party Square Capital, LLC.

 

Expiration Date: Value does not expire.

 

E-Gift Cards will be sent immediately upon successful completion of your transaction. If you wish to delay delivery to arrive on a birthday or anniversary, please send it to yourself first and then either print to send via postal mail; or forward via e-mail on the date you wish.

 

Use of card constitutes acceptance of the following terms and conditions: Gift Card may be used only Olive Branch Culinary Services and not for any other goods or services. Unless required by law, card is not redeemable for cash. Card is not valid if altered or illegible, and lost or stolen cards cannot be replaced. Card is not for resale by consumer. Card may be deactivated or rejected if issuer, in its sole discretion, suspects fraud. This card does not expire and there are no associated fees.

Changes to Terms and Conditions 

Olive Branch Culinary Services reserves the right, in its sole discretion, to change the Terms & Conditions under which www.olivebranchcs.com is offered. The most current version of the Terms & Conditions will supersede all previous versions. Olive Branch Culinary Services encourages you to periodically review the Terms & Conditions to stay informed of our updates.
